How to File an L&I Claim
If you’ve been injured or developed an illness due to your work in Washington State, you might be eligible for workers' compensation benefits. Filing a claim can be a complex process, but understanding the steps involved can help ensure that you receive the compensation you're entitled to. This guide provides the essential information to help you file your L&I claim.
1. What Should I Do If I’ve Been Injured or Exposed at Work?
If you've suffered an injury or have been exposed to a harmful substance or condition on the job, your first step is to seek medical care. It’s important to notify your employer right away, as this creates a record of your injury or exposure. Your employer will need this information for their report, and it helps establish the details of the incident for your claim.
Once you’ve reported the incident, consult a doctor to evaluate your condition. Be sure to inform your healthcare provider that this is a workers' compensation claim, as this will guide the completion of the necessary medical documentation.
2. How Do I File an L&I Claim?
To begin the claims process, you'll need to file your L&I claim. Here are the three ways you can do so:
- Online: Use L&I’s “FileFast” tool to submit your claim from your computer or mobile device. It’s simple and quick, but make sure the information you provide is accurate.
- By Phone: Call L&I at 877-561-FILE (3453) to file your claim. Monday – Friday, 8 a.m. – 5 p.m.
- Through Your Doctor: In some cases, your doctor may help you complete the Report of Accident (ROA) form and submit it directly.
It’s important to file your claim as soon as possible. In Washington, you have one year from the date of your injury to file a claim. For an occupational disease, you have two years from the date it becomes apparent. Delaying could jeopardize your claim.
3. What If My Employer Is Self-Insured?
If you work for a self-insured employer, you will need to complete a Self-Insured Accident Report (SIF-2) form. This form can be obtained from your employer’s human resources department, or your doctor may assist in filing it. This is just as valid as filing through a state-managed fund.
4. Can My Employer Retaliate Against Me for Filing a Claim?
No, your employer is prohibited from retaliating against you for filing a workers' compensation claim. If you feel you are being discriminated against for pursuing your claim, you can file a complaint with the Washington State Department of Labor & Industries.
5. How Long Do I Have to File a Claim?
You must file your claim within one year of the injury, or two years for an occupational disease. Be mindful that delaying filing could harm your ability to receive benefits or make it harder for you to win your case.
6. What Benefits Can I Receive?
Once your claim is approved, you could be entitled to several benefits, including:
- Time Loss Compensation: This covers a portion of your lost wages while you’re unable to work.
- Medical Benefits: Coverage for medical expenses related to your injury or illness.
- Permanent Partial Disability: A lump sum payment if you suffer permanent impairments.
- Vocational Training: If your injury prevents you from returning to your previous job, you may be entitled to training for a new career.
7. Do I Have to Report My Injury to My Employer?
While there’s no law requiring immediate reporting of injuries, most employers have their own internal policies. It’s a good idea to report any injury or illness as soon as possible to comply with both your employer’s policy and the L&I requirements.
8. What Should I Do If My Claim Is Denied?
If your claim is denied, you have 60 days from the denial to file an appeal. You can submit your protest online or via mail to the Department of Labor & Industries. Make sure to include all relevant information to support your case.
9. How Can I Ensure My Claim Is Successful?
To maximize your chances of a successful claim, follow these steps:
- Seek Medical Care: Ensure you receive timely and proper treatment.
- Choose Your Doctor Wisely: You have the right to choose your treating physician. A doctor experienced with workers' compensation claims is beneficial.
- Follow L&I Orders: Pay attention to the orders you receive from L&I, and be sure to take action if necessary.
10. How Do I Close My L&I Claim?
When you reach a point where your condition has stabilized, and you are either able to return to work or are receiving vocational training, you will work with L&I or your attorney to settle your claim. This could involve a lump sum settlement or the potential for a pension if you are permanently disabled.
Why Consulting an Experienced L&I Attorney Can Help
Filing an L&I claim can seem overwhelming, but understanding the process and your rights is the first step toward getting the compensation you deserve. If you're unsure about how to proceed or if you're encountering difficulties, it may be helpful to consult with an experienced L&I attorney who can guide you through the process and help ensure your claim is handled correctly. Remember, the sooner you file, the better your chances of receiving full benefits.

They have been entirely helpful since they accepted my case. Thorough and informative every step of the way. When I had an IME and no gas in my car they arranged for a ride to and from. After fighting tooth and nail myself with little to no results Palace Law stepped in and immediately Sedgwick stopped dragging me through the mud.
